Recently, this issue was brought to the forefront of public discourse as a result of the killing of George Floyd by an officer in the Minneapolis Police Department who knelt on his neck for nearly nine minutes while other officers on scene did not intervene.
This incident reinforced the dire need for police departments to require that officers hold each other accountable and stop the use of excessive force when they see it. As a result, it is crucial to define these terms so that both officers and the public can clearly understand what APD requires of its officers.
Second, the definition of "objectively reasonable" should not contain the word "objective. Clear policies allow officers to know exactly what is required of them. Additionally, clear policies help to ensure appropriate enforcement by allowing decisionmakers to hold officers accountable in a consistent and predictable manner.
In particular, the General Orders should contain a centralized policy that sets forth a requirement for officers to intervene when they witness any conduct by another officer that would constitute a violation of state law, federal law, or APD policy.

Nonetheless, I am not sure that his definition of duty supports that conclusion. Monica and Antonio both asked whether governments can be bound by laws. For Austin, the answer is no, at least as far as the sovereign is concerned. Laws are commands issued by a sovereign, commands are necessarily addressed to someone else, therefore, the sovereign cannot be governed by commands.
Again, if we find significant examples of parts of the law that do apply to sovereigns, this will pose a problem for Austin. Only the sovereign is above the law. Austin says that judges get their power to make law from the sovereign Austin [] , 32— What could that mean in his theory?
Are they commanded to do something? Maybe something else. This will come up when we read Hart. Roughly, if a command is issued by someone in a position to make a law, then it is a law provided it meets the other conditions for being a law, of course. If it is not made by someone in position to make a law, it is not.
But Hart is a major critic of Austin. To keep your wits about you, it is probably best to think of Austin as claiming that laws are commands and Hart as claiming that laws are rules. There are many problems, but Afghanistan is more of a symptom than the disease.
The real problem is Biden is a feeble man and an ineffectual leader. Well, in the words of the first Delta Force Commander, Lt. Bragg and he was a friend. I think Lloyd had a very distinguished career. We see a few potential courses of action. Here are two. Course of action one — Austin resigns quietly. It would be in disgrace, but he will be able to live in retirement the rest of his life or perhaps be on the board of a multi-billion-dollar corporation.
But, if he really wants to honor the roots of his education at West Point and his brilliant career, then he will choose the following harder right over the easier wrong, and fix our armed forces. Course of action two: Tell the troops that he made some grave judgement errors, that he knows America and the troops demand the best. Show a substantial and strong commitment to right the ship.
Cancel all contracts involving teaching CRT. Make a required-reading list for officers that promotes patriotism and effective military leadership. Discourage books which create division books not worth mentioning here!
If he is directed to act in a way that weakens our military in any way, he should refuse, and initiate policies that only serve to strengthen our military and build American patriotism. If Biden fires Austin for taking steps to turn things around which Biden may in fact do anyway , Austin would be redeemed and earn back the respect of many troops and officers.
Biden just sent several thousand troops to Afghanistan and, unfortunately, the Afghanistan conflict will continue to drag on. What is the more likely course of action Austin will take? The easier one is submitting his resignation. The harder is to right the ship. Please support them by shopping at ConservativeEconomy.
